1.WHAT PRODUCT IS COVERED BY THIS QENERGYSPA WARRANTY?
The following product is covered by this warranty:
Q2 Water Energy System Hydrotherapy System (“The Product”)
2.WHAT DOES THIS WARRANTY COVER?
Q-TECH LABORATORIES warrants to the original purchaser of “The Product” (“The Purchaser”) that “The Product” will be free from defects in materials or workmanship under normal use and service during the warranty period described in Paragraphs 3 and 4.
3. WHEN DOES YOUR WARRANTY BEGIN?
The warranty will begin on the day “The Purchaser” takes possession of “The Product”. Dated proof of purchase must accompany “The Product” returned for warranty service consideration. Valid proof of purchase identifies the point of purchase, date of purchase, model or trade name. Ordinarily, “The Purchasers” sales receipt or invoice will suffice or a copy thereof.
4. HOW LONG DOES THE COVERAGE LAST?
The warranty for “The Product”, excluding Consumable items as listed in paragraph 6 section V: One (1) Month for the full “PRODUCT” with an extension to 12 MONTHS, only if the original warranty registration card is returned to Denver Nutrition, LLC/Q The Experience WITHIN 30 DAYS OF PURCHASE.
All returns/refunds will be billed a 25% restocking fee.
5. WHAT WILL Q-TECH DO IF “THE PRODUCT” BECOMES DEFECTIVE IN MATERIALS OR WORKMANSHIP DURING THE WARRANTY PERIOD?
If “The Product” covered under this warranty becomes defective in materials or workmanship during the applicable warranty period, Q-TECH will, at it’s option, either repair the defective Product without charge for it’s parts and labor, or provide a replacement in exchange for the defective Product. Q-TECH reserves the right to provide, at no extra cost, a more current upgraded model for replacement, if available.
6.WHAT IS NOT COVERED BY THIS WARRANTY?
This warranty does not extend to:
I. Products that have been subjected to misuse, accident, and physical damage, improper installation, abnormal operation or handling, neglect, inundation or fire.
II. Products that have been damaged due to repair, alteration or modification by anyone other than an authorized representative of Q-TECH Laboratories Pty Ltd.
III. Defects caused by components, parts, or accessories not compatible with the warranted Product.
IV. Products, whose warranty/quality stickers, product serial number plates or electronic serial numbers have been removed, altered or rendered illegible.
V. Accessory items and Consumables including, the Positive Plate & Track sets, Array Cables, Fuses, Carry Bag or Towel .
VI. When used in a Professional, Semi Professional environment please contact Head Office for terms and conditions of warranty on your Product. ANY OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. Q-TECH’S TOTAL LIABILITY FOR DAMAGES FOR ANY CAUSE RELATED TO, OR ARISING OUT OF, THE USE OR INABILITY TO USE “THE PRODUCT”, WHETHER IN CONTRACT, NEGLIGENCE, STRICT TORT OR BASED ON ANY OTHER LEGAL ASPECT, SHALL NOT EXCEED THE ORIGINAL PRICE PAID FOR “THE PRODUCT”. IN NO CASE SHALL Q-TECH BE LIABLE FOR ANY INDIRECT SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT OR ANY OTHER LEGAL THEORY, SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF PROFITS, LOSS OF SAVINGS OR REVENUES, INABILITY TO USE “THE PRODUCT” OR ANY ASSOCIATED EQUIPMENT, COST OF CAPITAL, COST OF ANY SUBSTITUTE EQUIPMENT, FACILITIES OR SERVICES, CLAIMS BY THIRD PARTIES OTHER THAN YOU, AND INJURY TO PROPERTY.
7. HOW DO YOU GET WARRANTY SERVICE?
If your product requires warranty service, you must first contact Product Support to receive a “Return Authorization” or an RA number. We have repair facilities in both USA and Australia. – soon to expand to Europe. Once you obtain an RA Number, “The Purchaser” must return “The Product” to Q-TECH or an Authorized repairer, shipping prepaid both ways, along with a description of “The Product” malfunction or difficulty and your RA Number. You must also substantiate warranty status with dated proof of purchase (as explained in paragraph 3), inclusive of The Product’s serial number: The address where you should send “The Product” to receive warranty service is available when obtaining your RA Number. Q-TECH assumes no risk for damage or loss in shipment. If, in Q-TECH’S sole opinion, “The Product” failure is not covered under this warranty “The Purchaser” will be notified and an authorization will be requested for any further repair activity. Products repaired under warranty will be returned to “The Purchaser” transportation prepaid by “The Purchaser”. “The Purchaser” must pay return shipping costs for “The Product” (s) repaired, which are not covered by warranty, or “The Product” (s) for which “The Purchaser” does not wish to authorize repairs.
8.THIS WARRANTY IS THE ENTIRE AGREEMENT
Unless modified in writing, signed by both “The Purchaser and Q-TECH, this warranty is understood to be the complete and exclusive agreement between the parties, superseding all prior agreements, oral or written, and all other communications between the parties relation to the subject matter of this warranty. No Agent or Employee of Q-TECH may make modifications to this warranty and such representations should not be relied upon.
